Terms of Service

1. Agreement

These Terms govern your access to OpenNext AI, including its directory, product submission tools, product management links, outbound links, and paid Sponsored placements. By using the service, submitting a product, or purchasing a placement, you agree to these Terms, the Ranking Rules, the Privacy Policy, and the Refund Policy.

You must be legally able to enter into a binding agreement. If you act for a product, business, or other person, you confirm that you have authority to bind them.

2. The service

OpenNext AI provides two separate discovery surfaces:

• Organic listings, which are reviewed product submissions and are not ranked by payment.
• Sponsored placements, which are paid advertising positions ranked under the public Ranking Rules.

Sponsored content is labeled. Buying a placement does not buy an endorsement, review, certification, permanent listing, ownership right, or exclusive category position.

3. Product submissions and ownership

You must provide accurate, current information and have the right to submit all names, descriptions, logos, images, URLs, and other materials. You grant OpenNext AI a worldwide, non-exclusive, royalty-free license to host, reproduce, resize, and display those materials only as needed to operate and promote the directory.

We may retrieve publicly available metadata from a submitted website. You remain responsible for reviewing it. Free submissions may be reviewed before publication. A new Sponsored submission may publish automatically after trusted payment confirmation, but all listings remain subject to post-publication review. We may edit formatting, request evidence, reject a submission, suspend a listing, or remove content that is inaccurate, unsafe, unlawful, deceptive, infringing, inactive, or inconsistent with these Terms.

An Owner email may be omitted for a free submission. An unclaimed listing cannot be edited until ownership is verified. Anyone may purchase Sponsored placement for an approved product, but payment does not establish ownership, representation, or editing rights. Ownership disputes are reviewed manually; approval of a claim requires email verification and may return the product to review.

4. Sponsored placements and ranking

A Boost purchases digital advertising exposure for the applicable weekly period. The board runs from Monday 00:00 UTC to the following Monday 00:00 UTC. Confirmed effective payments determine order for that week only. Other products may purchase or increase placements at any time, so a rank can change after your payment.

The minimum first Boost is USD $10. An existing placement may be increased by at least USD $1. To take first place, the target total must be at least USD $5 above the current leader. Equal totals are ordered by the time each product first reached that amount. Full details are in the Ranking Rules.

5. Orders, payment, and taxes

Prices are stated in USD and processed in integer cents. The amount due is calculated by our server from the product's confirmed current-week total; a price or rank supplied by a browser is not authoritative. Placement changes only after a trusted payment confirmation.

Payments are processed by an independent payment provider and, where applicable, Merchant of Record such as Dodo Payments. The provider may collect billing details, apply its own terms, perform fraud checks, calculate taxes, issue receipts, and decline transactions. OpenNext AI does not receive or store full payment-card details.

You are responsible for any taxes or charges that the payment provider does not collect on your behalf. You must not use a payment method without authorization.

6. Refunds, disputes, and chargebacks

Sponsored delivery starts when payment is confirmed. Because the placement begins immediately, payments are generally final and non-refundable once delivery starts. We do not refund a later rank change, being outbid, low traffic, low conversion, or dissatisfaction with results. See the Refund Policy for the short list of exceptions and how to contact us.

This does not limit mandatory consumer rights, duplicate or incorrect charges, unauthorized or fraudulent payments, a material failure to deliver the paid placement, or a refund required by the payment provider or applicable law. Approved refunds return to the original payment method. A refund, payment reversal, or opened chargeback reduces the amount effective for ranking and may change or remove the placement; the original transaction remains in our audit records.

7. Prohibited use

You may not submit or promote content that is illegal, deceptive, infringing, malicious, unsafe, discriminatory, adult-oriented, exploitative, or designed to facilitate fraud. Without prior written approval, the service may not be used to promote gambling, unlawful financial products, unlicensed medical or legal services, weapons, controlled substances, malware, credential theft, counterfeit goods, or sanctions evasion.

You may not manipulate clicks or rankings; use bots to create false traffic; probe, scrape at harmful volume, reverse engineer, or disrupt the service; bypass access controls or rate limits; impersonate another owner; or submit personal information without lawful authority.

8. Intellectual property and third-party sites

OpenNext AI's name, interface, software, and original content are protected by applicable intellectual-property laws. Product names and assets remain the property of their respective owners. Listings and outbound links are informational or advertising references, not claims of affiliation or endorsement.

Third-party products control their own sites, claims, security, privacy, and availability. You visit and use them at your own risk. Report suspected infringement or harmful content through the product's report form or the Contact page.

9. Availability and changes

We may maintain, modify, suspend, or discontinue features; correct data; and protect the service from abuse. We do not promise uninterrupted or error-free availability. Closed weekly leaderboards are intended to remain frozen, except where correction is required for fraud, payment reversal, legal compliance, or a material technical error.

10. Disclaimers and liability

To the maximum extent permitted by law, the service is provided “as is” and “as available,” without implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, or commercial outcome. Nothing in these Terms excludes warranties or liabilities that cannot legally be excluded.

To the maximum extent permitted by law, OpenNext AI and its operator will not be liable for indirect, incidental, special, consequential, exemplary, or lost-profit damages arising from the service, a listing, a ranking change, or a third-party product. For a claim related to a paid placement, aggregate liability will not exceed the amount you paid for the affected placement. This limitation does not apply where prohibited by law.

11. Suspension and termination

We may reject, suspend, or remove a listing or restrict access when reasonably necessary to enforce these Terms, respond to legal requests, protect users or the service, investigate ownership, or address payment risk. Provisions that by their nature should survive will continue after termination.

12. Governing terms and updates

The governing law, venue, and operator dispute address are TBD before production launch and will be completed after legal review for the operator's actual jurisdiction. Mandatory consumer rights in your country or region remain unaffected.

We may update these Terms. Material changes will be identified by a new effective date and, where required, additional notice. New paid orders will record the applicable Terms version.
